Not necessarily. Krita is Free Open Source Software (FOSS) and according to the license anyone can develop it further according to their own ideas, at least as long as they adhere to the license conditions. Even sale is conceivable.
And there could be the crux of this release! Does this “Brian Studio” keep to the license?
Next comes the trademark side, is “Brian Studio” allowed to call its version Krita Pro? The name Krita is, if I am informed correctly, a registered trademark, or similarly protected. If “Brian Studio” had simply called his product “Professional painting program based on Krita”, then this could probably not be prosecuted, but Krita Pro as a name is very likely not okay, so purely legally not, since it is much too “close” to the original name.

Further, I’m not sure if the icon of Krita used by this “Brian Studio”, unlike the source code of Krita, is trademarked and subject to copyright. I spent some time yesterday searching the forum for a posting in which this has been addressed here before, but unfortunately there are a lot of hits for the search terms I used. In this context, it would also be interesting to know if this Krita Pro uses the splash screen of “our” Krita, because the splash screen may most likely not be “stolen” either. If “Brian Studio” should be so cheeky and include in his “work” the “Backers” listed under ‘‘Help’’ >> ‘‘About Krita’’, then this would be a further impudence beyond compare. Because I don’t know if any of the ‘‘Backers’’ of Krita would like to be associated with the creation “Krita - Digital Painting Pro” by “Brian Studio”, I myself doubt this at least.

That is indeed the likely reason the search prompt returned that information to me, it is new but perhaps the information was unavailable to the language process
